The Medicare Secondary Payer regulations were established in 2001 and apply to Workers' Compensation, Liability and No Fault Claims. Substantial written guidance has been provided on WC matters by the Centers for Medicare and Medicaid over the years since 2001. Minimal guidance is/has been offered on Liability cases beyond assertion that MSP applies to Liability cases as well as Workers' Compensation cases. 


CMS has now, for the second time, filed an Advanced Notice of Proposed Rule Making as to MSP. The first was withdrawn several years ago after being submitted to the Office of Management and Budget (OBM) because a requirement in rule making is that OBM must verify that changes will be at least 'revenue neutral'. It is expected that some clarity on the rule making will be announced September 2019. 


A number of questions will arise from this process and some recent cases circumstances include: 

  • Will the guidance on WC matters be made rule of law?
  • Will Liability matters be included and be rule of law? 
  • Who will bear the responsibility to comply in Liability cases?
  • What will be the recourse for non-Compliance? 
  • And, one of the biggest concerns for all parties in a Liability manner revolves around the future aspect of MSP Compliance. 

Potential upcoming CMS changes may lean toward placing the burden on the Claimant/Plaintiff taking responsibility for considering Medicare's interests, but it remains to be seen what CMS will ultimately decide.
